CHAPTER 2. NATIONAL FLAG OF THE REPUBLIC OF TAJIKISTAN
Article 5. Procedure for hoisting the National Flag of the Republic of Tajikistan
1. The National Flag of the Republic of Tajikistan is constantly raised:
– on buildings, facades or on special props in the courtyard of the official residence of the President of the Republic of Tajikistan, Majlisi milli Majlisi Oli of the Republic of Tajikistan, Majlisi namoyandagon Majlisi Oli of the Republic of Tajikistan, the Government of the Republic of Tajikistan, the courts of the Republic of Tajikistan, the prosecution authorities of the Republic of Tajikistan, the National Bank of Tajikistan, the Central Electoral Commission on Elections and Referendums of the Republic of Tajikistan, ministries, Office of the Ombudsman of the Republic of Tajikistan, state committees and government bodies of the Republic of Tajikistan, local government bodies, self-government bodies of towns and villages (communities), diplomatic missions and other organizations of the Republic of Tajikistan abroad and to the international organizations (as amended by the Law of the Republic of Tajikistan dated March 25, 2011, No. 695, dated November 14, 2016, No. 1376);
– on the buildings where joint meetings of the Majlisi milli and Majlisi namoyandagon Majlisi Oli of the Republic of Tajikistan, sessions of the Majlisi milli Majlisi Oli of the Republic of Tajikistan, sessions of the Majlisi namoyandagon Majlisi Oli of the Republic of Tajikistan, sessions of the Majlises of the people’s deputies, deputies of the Gorno-Badakhshan Autonomous Province, Majlises of people’s deputies of the regions, the city of Dushanbe, cities, districts, meetings of communities of towns and villages are held;
– in the halls of joint meetings of the Majlisi milli and the Majlisi namoyandagon Majlisi Oli of the Republic of Tajikistan, sessions of the Majlisi milli Majlisi Oli of the Republic of Tajikistan, sessions of the Majlisi namoyandagon Majlisi Oli of the Republic of Tajikistan, the Council of the Majlisi milli Majlisi Oli of the Republic of Tajikistan and the Council of the Majlisi namoyandagon Majlisi Oli of the Republic of Tajikistan, meetings of the Government of the Republic of Tajikistan, sessions of local Majlises of people’s deputies, meetings of local executive bodies of state authority, meetings of communities of towns and villages, court sessions of the courts of the Republic of Tajikistan, civil registry offices;
– in the offices of the President of the Republic of Tajikistan and other buildings intended for holding official events with the participation of the President of the Republic of Tajikistan, in the offices of the Chairman of the Majlisi milli Majlisi Oli of the Republic of Tajikistan and his deputies, of the Chairman of the Majlisi namoyandagon Majlisi Oli of the Republic of Tajikistan and his deputies, members of the Majlisi milli Majlisi Oli of the Republic of Tajikistan, deputies of the Majlisi namoyandagon Majlisi Oli of the Republic of Tajikistan, Prime Minister of the Republic of Tajikistan and his deputies, Head of the Executive Office of the President of the Republic of Tajikistan, Head of the Executive Office of the Majlisi milli Majlisi Oli of the Republic of Tajikistan, Head of the Executive Office of the Majlisi namoyandagon Majlisi Oli of the Republic of Tajikistan, ministers, chairmen of state committees, heads of other government bodies of the Republic of Tajikistan, Chairman of the Constitutional Court of the Republic of Tajikistan, Chairman of the Supreme Court of the Republic of Tajikistan, Chairman of the Supreme Economic Court of the Republic of Tajikistan, Prosecutor General of the Republic of Tajikistan, Chairman of the Central Election Commission for Elections and Referendums of the Republic of Tajikistan, Chairman of the National Bank of Tajikistan, Ombudsman of the Republic of Tajikistan, chairmen of the Gorno-Badakhshan Autonomous Province, regions, Dushanbe city, cities, districts, communities of towns and villages, deputies of local Majlises of people’s deputies of Gorno-Badakhshan Autonomous Province, regions, Dushanbe city, cities, districts, chairmen of military courts, chairmen of courts of Gorno-Badakhshan Autonomous Province, regions, Dushanbe city, cities, districts, chairmen of the economic courts of the Gorno-Badakhshan Autonomous Province, regions and the city of Dushanbe, the Chief Military Prosecutor, the prosecutors of the Gorno-Badakhshan Autonomous Province, regions, the city of Dushanbe, the transport prosecutors of Tajikistan, the prosecutors of cities and districts, military prosecutors of garrisons, prosecutors for supervision over the execution of laws in penitentiary facilities, heads of diplomatic missions and other organizations of the Republic of Tajikistan in foreign states and international organizations;
– in military units of the Republic of Tajikistan (in accordance with military regulations), at checkpoints, border outposts and customs points of the state border of the Republic of Tajikistan.
2. The National Flag of the Republic of Tajikistan can also be installed in places of recreation for citizens, parks, avenues, squares as a state symbol of the Republic of Tajikistan.
Citizens of the Republic of Tajikistan have the right to use the National Flag with manifestation of respect for it.
3. During the hoisting of the National Flag of the Republic of Tajikistan and the flag of public organizations or other legal entities, regardless of the form of ownership, the width and height of these flags should not exceed the width and height of the National Flag of the Republic of Tajikistan. In cases of simultaneous raising of an odd number of flags, the National Flag of the Republic of Tajikistan is set in the middle, and in cases of raising an even number of flags, it is set from the center to the left.
4. The National Flag of the Republic of Tajikistan is also installed:
– on the vehicles of the President of the Republic of Tajikistan, the Chairman of the Majlisi milli Majlisi Oli of the Republic of Tajikistan, the Chairman of the Majlisi namoyandagon Majlisi Oli of the Republic of Tajikistan, the Prime Minister of the Republic of Tajikistan, heads of state and government structures of the Republic of Tajikistan outside the Republic of Tajikistan, heads of diplomatic missions and other organizations of the Republic of Tajikistan in foreign states and international organizations or other persons in accordance with the procedure established by the Government of the Republic of Tajikistan;
– on buildings, facades or on special props in the yard where voting takes place;
– on holidays and during celebrations in administrative and social-public and private structures and buildings, residential buildings, places of recreation for citizens, parks, avenues and squares.
– upon the declaration of mourning, the National Flag of the Republic of Tajikistan is hoisted in mourning design: a black ribbon is attached to the flagpole, the ends of which should hang down to the bottom of the flag. When the flag is hoisted on a flagpole during mourning, the flag is lowered to 1/3 of the length of the flagpole.
5. During the mourning of a deceased (killed) citizen, in accordance with the military honors established by the Military Regulations, the coffin with the body of the deceased is covered with the flag of the Republic of Tajikistan. After the burial, the National Flag is handed over to the relatives of the deceased.
Article 6. Placement of the image of the National Flag of the Republic of Tajikistan
1. The image of the National Flag of the Republic of Tajikistan is placed:
– on airplanes, helicopters and ships registered in the Republic of Tajikistan;
– on the national currency of the Republic of Tajikistan, securities and state money and clothing lottery tickets;
– on badges and certificates of a member of the Majlisi milli and a deputy of the Majlisi namoyandagon Majlisi Oli of the Republic of Tajikistan;
– on badges and certificates of a deputy of the local Majlis of people’s deputies and a deputy of a community;
– on badges of civil servants;
– in places of rest of citizens, avenues, squares, in television screen savers and other state publications as a state symbol;
– in the state registration plates of vehicles in the order determined by the legislation of the Republic of Tajikistan.
DESCRIPTION
of the State Flag of the Republic of Tajikistan
(Adopted by the Resolution of the Majlisi Namoyandagon of the Majlisi Oli of the Republic of Tajikistan dated March 14, 2007, No. 499
“On approval of the State Flag of the Republic of Tajikistan”)
The State Flag of the Republic of Tajikistan is a rectangular cloth with three horizontally arranged colored stripes: upper stripe of red color and equal to it in width lower stripe of green color, middle – white stripe, which is one and a half widths of the colored stripes. On the white stripe at a distance of half the length of the cloth from the shaft there is a stylized crown in gold and a semicircle of seven stars above it. The overall width to length ratio of the flag is 1:2.
The crown and stars are contained within a rectangle whose vertical sides measure 0.8 and horizontal sides measure 1.0 the width of the white stripe. The five-pointed stars fit within a circle with a diameter of 0.15 and are arranged along an arc with a radius of 0.5 the width of the white stripe.
The crown with a height of 0.55 the width of the white stripe, arches from its base along an arc with a radius of 1.2 the width of the white stripe. Four arc-shaped elements form the top of the crown, culminate in the center with a circular segment of 0.2 the width of the white stripe.

Article 7. The use of the National Emblem of the Republic of Tajikistan
The National Emblem of the Republic of Tajikistan is used in color, monochrome and black and white image.
Article 8. Placement of the image of the National Emblem of the Republic of Tajikistan
- The image of the National Emblem of the Republic of Tajikistan is placed:
– on the building portals of the official residence of the President of the Republic of Tajikistan, Majlisi milli Majlisi Oli of the Republic of Tajikistan, Majlisi namoyandagon Majlisi Oli of the Republic of Tajikistan, the Government of the Republic of Tajikistan, the courts of the Republic of Tajikistan, Prosecutor General’s Office of the Republic of Tajikistan, the National Bank of Tajikistan, the Central Electoral Commission on Elections and Referendums of the Republic of Tajikistan, ministries, state committees and other government bodies of the Republic of Tajikistan, local government bodies, self-government bodies of towns and villages (communities), diplomatic missions and other organizations of the Republic of Tajikistan in foreign states and the international organizations;

– on state publications of the Republic of Tajikistan;
– on the passport of a citizen of the Republic of Tajikistan and on other passports and certificates issued by state bodies;
– at border posts and checkpoints of the state border of the Republic of Tajikistan;
– on the national currency of the Republic of Tajikistan, securities and state tickets of the money and clothing lottery;
– on state awards of the Republic of Tajikistan and documents certifying them;
– on insignia and official uniform of persons performing military service or other public service.
2. In cases of simultaneous placement of the National Emblem of the Republic of Tajikistan and the emblems of public organizations and other legal entities, regardless of the form of ownership, the size of these emblems should not exceed the size of the National Emblem of the Republic of Tajikistan and in this case the National Emblem of the Republic of Tajikistan should be placed on the left.
3. Placement of the image of the National Emblem of the Republic of Tajikistan in places not provided for by this Law is prohibited.

The State Emblem of the Republic of Tajikistan features a stylized crown and a semicircle of seven stars above it, in the rays of the sun rising from behind snow-covered mountains, depicted with a wreath composed of wheat ears on the right and cotton branches with opened bolls on the left. The top of the wreath is intertwined with a tricolor ribbon and an open book on a stand is placed in the lower sector.
The State Emblem of Tajikistan is colored: the crown, sun, mountains, wheat ears, book and stand are gold, cotton stalks and leaves are green, the stripes on the ribbons are red, white and green, the book cover is red.

CHAPTER 4. NATIONAL ANTHEM OF THE REPUBLIC OF TAJIKISTAN
Article 9. National Anthem of the Republic of Tajikistan and the order of its performance
1. The National Anthem of the Republic of Tajikistan, as a symbol of state independence, consists of text and music, and is performed in cases established by this Law.
2. The National Anthem of the Republic of Tajikistan is performed by an orchestra, choir, orchestra – choir or other vocal and instrumental orchestras. For the performance of the National Anthem of the Republic of Tajikistan, the technical means of sound recording can also be used.
3. When the National Anthem is performed by vocals (singing), the instrumentality is performed in full; when the musical instrumentality is performed partly, the beginning of the Anthem is performed, and the chorus is performed once.
4. The National Anthem of the Republic of Tajikistan must be performed exactly in accordance with the text and music.
5. At the official performance of the National Anthem of the Republic of Tajikistan, those present rise from their seats.
Article 10. Cases of performance of the National Anthem of the Republic of Tajikistan
1. The National Anthem of the Republic of Tajikistan is performed:
– after taking the oath by the President of the Republic of Tajikistan before assuming office;
– at the opening and closing of joint meetings of the Majlisi milli Majlisi Oli of the Republic of Tajikistan and the Majlisi namoyandagon Majlisi Oli of the Republic of Tajikistan, sessions of the Majlisi milli Majlisi Oli of the Republic of Tajikistan, sessions of the Majlisi namoyandagon Majlisi Oli of the Republic of Tajikistan, sessions of the Majlises of people’s deputies of the Gorno-Badakhshan Autonomous Province, regions, Dushanbe, cities and districts, solemn meetings, events and other celebrations declared nationwide, in accordance with the regulatory legal acts of the Republic of Tajikistan;
– daily before the start and end of the transmission of programs of state television and radio broadcasting;
– when holding anniversary celebrations and meetings and other events held by state bodies, public organizations and other legal entities, regardless of the form of ownership, with the permission of the executive bodies of state authority;
– during the official ceremonies of unveiling of monuments, sculptures, commemorative plaques and other relevant structures, the most important historical, state and social events in honor of the heroes of Tajikistan, prominent political, state, military figures, workers of science, literature and culture;
– when awarding state awards to the Gorno-Badakhshan Autonomous Province, regions, the city of Dushanbe, cities and districts, settlements, enterprises, institutions and organizations;
– during meeting and seeing off of the heads of state and government of foreign states, officially arriving in the Republic of Tajikistan, after the performance of their National Anthem;
– during military activities;
– when holding general celebrations in schools of general, primary, secondary and vocational higher education of the Republic of Tajikistan;
– when holding international and domestic sports competitions in accordance with the rules for holding these competitions;
– when holding official events on the territory of foreign states in the order determined by the Ministry of Foreign Affairs of the Republic of Tajikistan, taking into account the official procedures of the respective state.
2. The National Anthem of the Republic of Tajikistan is simultaneously performed during the raising of the National Flag of the Republic of Tajikistan, and those present turn towards the National Flag.
